Commissioner of Oaths

Commissioner of Oaths services are offered through the Legislative & Information Services Department, at Ajax Town Hall and include affidavits, oaths and statutory declarations. The Town does not have a Notary Public and cannot notarize documents. A list of Notary Publics and lawyers, who can notarize documents, can be found in your local phone directory.

Since the requirements of the documents vary, it is recommended that you contact the Town of Ajax in advance of your visit to confirm that your documents can be commissioned by the Town. Please click here for a list of documents the Town of Ajax is authorized to commission.

Commissioners for the Town of Ajax are not authorized to sign any documents related to the following:

  • Wills, “Living” Wills, Codicils to Wills
  • Powers of Attorney
  • Divorce, Separation, Marriage, or Cohabitation documents
  • Custody documents
  • Documents related to Debt and Finances
  • Real Estate related documents
  • Estate Settlement Documents
  • Court, Legal and/ or Civil Issue-related documents
  • Declaration of Claimant and Indemnity
  • Declaration for Replacement of Shares
  • Statement of Arrears
  • Documents requiring signature of a Notary Public from countries outside of Canada
  • Statutory Declaration of Progress Payment Distribution – Holdback Security Deposits (Subcontractors)
  • Certified True Copies
  • Tender Affidavits
  • Declaration of a Translator
  • Age of Majority/BYID Card Application

To have a document commissioned, each party required to sign the document must visit the Legislative and Information Services Department in person. The request for the Commissioner of Oaths service must be made by the same individual(s) who will be taking the oath and signing the document. That individual must present an original piece of photo identification (no copies permitted) in the form of government issued photo identification (i.e. a valid driver’s licence, a valid passport) for each party required to sign the document. The document(s) to be commissioned must be signed in the presence of the Commissioner of Oaths.

The Town of Ajax charges a $15.00 fee payable by cash, debit or money order for every five (5) signatures. This service is offered Monday to Friday, 8:30 a.m. to 4:30 p.m. at Legislative & Information Services, Ajax Town Hall, 65 Harwood Avenue South. Birth Registration/Birth Certificates

New  Born's Toes

As of February 2009, birth registrations are processed by the Province of Ontario and not by the Town of Ajax. If you have not registered your baby, the Newborn Registration Service is a convenient way to complete up to three important transactions online at the same time.

1. Register the birth of your baby under the age of one year
2. Apply for your baby’s birth certificate
3. Apply for your baby’s Social Insurance Number.

If you are travelling with a newborn and need a birth certificate quickly, you can request it through the province’s Newborn Registration Service. Click here for more details. Travel letters are no longer issued by the Town of Ajax.

Home Births

All home births occurring in Ajax must be registered through Legislative and Information Services. The forms can be obtained at the Information Desk at 65 Harwood Avenue, Ajax, Ontario L1S 2H9.

PLease note: Birth registrations take up to 4 months; the fee for registering a birth is $25.00

 

Marriage Licences

Wedding RingsMarriage Licence applications can be processed in the Legislative and Information Services Department. The licence fee is $125.00 payable by cash or debit only and is valid for 90 days from the date of issue. The Town of Ajax will not refund marriage licence fees once a licence has been issued. The marriage licence is valid anywhere in the Province of Ontario. The licence will take approximately 15 minutes to process. We are open Monday to Friday (excluding statutory holidays) from 8:30 a.m. to 4:30 p.m.

Marriage Licence Requirements

The marriage licence application must be completed and signed by both applicants, however, only one party needs to present the completed application form. A marriage licence can only be issued to the applicant and/or joint applicant. Identification is required for both parties, regardless whether both parties attend the office.

First piece of identification must be:

  • Birth Certificate
  • Current Passport

Second supporting piece of identification must be one of the following:

  • Driver’s Licence
  • Canadian Citizenship or Immigration Record of Landing
  • Current Passport (providing it is not used as the first piece of identification)

The issuer will take a copy of the identification provided and attach it to the marriage licence application. Please note that we only accept original documents or true certified copies.

Age Requirements

Both partners must be 18 years of age or older. If you are 16 or 17 years of age, parental consent is required. Please contact the Office of the Registrar General at 1-800-461-2156 or 416-325-8305 for further information. If you are under the age of 16 years, you may not marry in the Province of Ontario.

Marriage after Divorce

If you were divorced in Canada, the original or court certified true copy of the Decree Absolute or Certificate of Divorce must be provided. It cannot be a photocopy; you can obtain a certified copy from the court that granted the divorce.

Divorce Outside of Canada

An applicant whose former marriage was dissolved or annulled in a jurisdiction other than Canada, must obtain authorization from the Office of the Registrar General before a marriage licence may be issued. A package can be picked up from the Legislative and Information Services Department, Ajax Town Hall, 65 Harwood Avenue South. To obtain this authorization, the applicants or a lawyer representing the applicants, must submit the following:

  • A completed marriage licence application bearing the original signatures of both applicants.
  • The original Certificate of Divorce or the Decree Absolute, or a court certified copy of same (certified by the proper court officer in the jurisdiction where the divorce or annulment was granted). If the decree is in a language other than English or French, include a translated copy together with an affidavit sworn by the translator.
  • A Statement of Sole Responsibility (click here for form) for each divorce signed by both applicants. Blank affidavits are available at the Legislative and Information Services Department or from the Registrar General’s Website. (Click here)
  • A legal opinion of an Ontario Lawyer, addressed to both applicants, giving reasons why the divorce or annulment should be recognized in the Province of Ontario.

Once approval has been received from the Office of the Registrar General, please present the marriage licence application form, together with the letter from the Office of the Registrar General addressed to Issuer of Marriage Licences. Blood Tests

Blood tests or medical certificates are not required in Ontario.

Widow or Widower

If either party to the marriage licence application is a widow or widower, they are not required to produce a death certificate to obtain a marriage licence.

 

Civil Marriage Ceremonies

Civil Marriage Ceremonies are now being offered by the Town of Ajax.

 

Lottery Licences

The Town of Ajax issues lottery licences in accordance with Provincial regulations for Bingo Lotteries up to a $5,500.00 prize board, Raffle Lotteries with a Prize board of $50,000.00 and under, and Break Open Tickets. Please visit Lottery Licences for further information.

 

Records Management & FOI Requests

Requests For Information under the Freedom of Information Act must be made in writing to the Records Co-ordinator and must include a $5 fee. Search time, photocopying and electronic rendering of requested material may be subject to further fees.
